Welcome to HostyXo. Whether you're setting up your first blog or moving a client's WordPress site over to our NVMe servers, these Terms & Conditions ("Terms") are the agreement between you and HostyXo — a web hosting and domain registration provider based in Bogura, Bangladesh — for use of our website, client area, and hosting, domain and related services (collectively, the "Services"). Creating an account, placing an order, or simply using the Services means you've agreed to what's written below. If any part of it doesn't sit right with you, the safest thing to do is not use the Services and reach out to us with your concerns first.
To register for an account or buy a Service from us, you need to be at least 18 years old, or have a parent or legal guardian's consent if you're younger. You also need the legal capacity where you live to enter into a binding contract. Signing up means you're agreeing not just to these Terms but also to our Privacy Policy and Refund Policy — they're written as one connected set of rules, not three separate documents you can pick and choose from.
We run shared hosting, WordPress-optimized hosting, VPS hosting, domain registration and transfer, DNS management, and a handful of add-ons — the current list and specs are always on our Pricing page. Plan specs, prices and what's included can change as we upgrade our infrastructure or adjust pricing, but whatever was in effect the moment you placed an order is what governs that specific order, not whatever the page says later.
Instead of creating a new password, you can sign up or log in using your existing Google, Facebook, or GitHub account. When you do, that provider shares your basic profile — name, email address, and profile photo where available — with us, and we create or match your HostyXo account from it. We never see or store your password for that provider; authentication happens entirely on their end. You can read more about what each of them shares in our Privacy Policy, and you're free to switch to a regular email/password login at any time from your account settings.
Shared infrastructure only works if everyone plays fair. So, on any Service you buy from us, please don't:
We run automated backups on most plans as a convenience, not a guarantee. Hardware fails, scripts have bugs, and things occasionally go wrong in ways nobody predicted — so the responsibility for keeping your own independent backup of your website, database, and email sits with you, not us. If you ever need a restore, contact support and we'll do what we can with the backups available, but we can't promise a specific recovery point unless you've been maintaining your own copies as well.
We can suspend or shut down a Service, with or without advance notice, if payment is overdue, the Acceptable Use Policy has been broken, a court or regulator requires it, or continuing to run the Service would put us or other customers at risk. On your end, you can cancel any Service at any time from the client area — cancelling stops future renewal billing, though it doesn't undo charges already billed. Our Refund Policy covers exactly what you're owed back, if anything, when you cancel.
If you believe content hosted on one of our servers infringes your copyright, send a notice to hello@hostyxo.com with the copyrighted work in question, the URL where it's hosted, and your contact details. We'll investigate and, where the claim holds up, take the content down or disable access to it. Repeat offenders lose their hosting with us — we don't keep re-hosting the same infringing material under a second warning.
To whatever extent the law allows it, HostyXo isn't liable for indirect, incidental, or consequential damages — lost revenue, lost data, lost business — that come from using or not being able to use the Services. If something does go wrong and we're found liable, the most you can recover from us for that Service is capped at what you actually paid us for it over the preceding 12 months.
The HostyXo name, logo, and everything about how this website is designed and built belongs to us, and using any of it without our written go-ahead isn't allowed. On the flip side, whatever you host with us — your site, your code, your content — stays entirely yours. Just make sure you actually have the rights to host what you're hosting; that part's on you, not us.
Sometimes things happen that neither side can control — natural disasters, internet backbone outages, government action, a data center-wide power failure. We won't be held responsible for a delay or failure to deliver the Services caused by an event genuinely outside our reasonable control, though we'll still work to get things back online as fast as we can.
These Terms are governed by the laws of the People's Republic of Bangladesh. If a disagreement comes up, we'd genuinely rather sort it out directly — email us and give our support team a real chance to fix it before escalating. If that doesn't resolve things, any dispute is subject to the exclusive jurisdiction of the courts of Bangladesh.
We update these Terms occasionally — usually to reflect a new feature, a policy clarification, or a change in law. Whenever that happens, the "Last updated" date at the top of this page moves, and if the change is significant we'll also try to flag it in the client area. Using the Services after an update means you've accepted the new version.
