Every notice is checked for the legally required elements, not auto-actioned.
Valid notices are typically actioned within one business day.
Customers can dispute a takedown they believe was made in error.
Accounts with repeated, valid takedowns are terminated.
The Digital Millennium Copyright Act (DMCA) gives copyright holders a way to request that infringing material be removed from a hosting provider's servers, and gives the accused party a way to respond if they believe the claim is wrong. This page explains how that process works for anything hosted on HostyXo, alongside our broader Acceptable Use Policy.
HostyXo provides the server; we don't review content on customers' behalf, so we're not in a position to know whether every file a customer uploads is properly licensed. When we receive a valid, complete takedown notice, we act on it. We also don't remove content based on a vague or incomplete complaint; the notice needs to meet the requirements below first.
The DMCA process is specifically for copyright infringement: someone hosting your copyrighted text, images, video, code, or other creative work without permission. It isn't the right tool for trademark disputes, defamation, privacy complaints, or general content you simply disagree with; those go through our Contact page instead, where our team can route them appropriately.
A valid notice needs to include all of the following, in writing:
Send takedown notices to hello@hostyxo.com with the subject line "DMCA Takedown Notice," or by mail to HostyXo, Sabgram, Bogura Sadar, Bogura, Bangladesh. Email is significantly faster.
If your content was removed and you believe that was a mistake or misidentification, you can file a counter-notice with the same core elements: your signature, identification of the removed material and where it was located before removal, a statement under penalty of perjury that you have a good-faith belief the material was removed in error, your contact information, and a statement consenting to the jurisdiction of the applicable federal court. We forward valid counter-notices to the original complainant, who then has the standard window to pursue the matter legally before we consider restoring the content.
Accounts that receive multiple valid, unrebutted takedown notices are terminated, consistent with our Acceptable Use Policy. A single mistaken upload isn't treated the same as a pattern of repeated infringement.
Knowingly filing a false takedown notice or counter-notice carries legal liability for the person filing it, under the DMCA's perjury provisions. File notices in good faith, based on an actual copyright claim.
Questions about a notice you've filed or received can go to hello@hostyxo.com or our Contact page.
